Agreement to these terms

These terms are the agreement between you and GoodCode for the use of goodcode.us. By using the site you accept them. If you do not, please stop using the site.

You need to be at least 16 to use this site, and if you are using it for a company you need the authority to accept these terms on that company’s behalf.

What this site is

This is a marketing website for a design and engineering studio. It describes what we do and shows work we have done. Nothing on it is an offer, a quote, a commitment to take on work, or professional advice of any kind, including security advice. Do not act on anything here as though it were advice about your own product or your own risk.

The case studies describe work delivered for named clients, published with their agreement. Results described in one engagement say nothing about what any other project will produce.

Our content

The design, code, copy, images and other material on this site belong to GoodCode or to the clients and licensors we credit. Client names, logos and product screenshots are the property of those companies and appear here to describe work we did for them.

You may read the site, and quote or link to it with attribution. You may not copy it wholesale, republish it as your own, or use our name, marks or client logos to suggest a relationship that does not exist. Writing on our blog may be quoted with a link back.

Acceptable use

Please do not do any of the following:

• Break the site, or try to. That includes automated attacks, denial of service, and probing for vulnerabilities without our written permission.
• Use the contact form for spam, marketing lists, recruiting blasts, or anything unlawful, defamatory or abusive.
• Scrape the site at a volume that degrades it, or use our content to train a model that reproduces it.
• Impersonate anyone, or misrepresent who you are or who you work for.

If you think you have found a security problem with this site, we would genuinely like to hear about it. Email [email protected] and give us a reasonable window to fix it before you publish anything.

What you send us

You keep ownership of anything you send through the contact form. By sending it you give us permission to read it, store it, and use it to reply to you and to scope the work you are asking about.

A web form is not a confidential channel, so do not send trade secrets or anything under an existing confidentiality obligation through it. Tell us you are in stealth and we will sign a mutual non-disclosure agreement before the first call.

If you send us an unsolicited idea, suggestion or feature request, we may use it without owing you anything for it. That is not us claiming your product. It is us being able to keep working in the same field without an argument about who thought of a common idea first.

Client work

These terms cover the website. They do not cover the work we do for clients. Any engagement is governed by a separate signed agreement, including its own terms on scope, payment, ownership of deliverables, confidentiality and liability. Where that agreement and these terms disagree about the work, that agreement wins.

Links to other sites

We link to client sites, our own profiles on other platforms, and things worth reading. We do not control any of them and we are not responsible for what they contain or what they do with your data. Their terms and privacy policies apply once you leave here.

Disclaimers

The site is provided as it is and as it is available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the site will be uninterrupted, error free, or free of anything harmful, and we do not promise that the information on it is complete or current. Some jurisdictions do not allow these exclusions, in which case they do not apply to you.

Limitation of liability

To the fullest extent the law allows, GoodCode is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of this site. Our total liability for any claim relating to this site is limited to US $100. This limit does not apply to liability that cannot be limited by law, including fraud, and it does not affect any liability under a separate signed agreement for client work, which has its own terms.

Indemnity

If your use of this site breaks these terms or the law and that causes a claim against us, you agree to cover our reasonable costs of dealing with it, including legal fees. We will tell you promptly about any such claim and let you take part in defending it.

Governing law and venue

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute about this site is subject to the exclusive jurisdiction of the state and federal courts located there, and both of us consent to that venue. If you are a consumer, the mandatory consumer protection law of the country you live in still applies to you.

General

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing something now does not mean we cannot enforce it later. These terms, with the privacy policy, are the whole agreement between us about this website. You may not assign them; we may assign them to a successor to our business.

Changes to these terms

We update these terms when the site changes or the law does, and the effective date at the top moves with them. Continuing to use the site after a change means you accept the updated terms.
